As you know from my previous post, the Cook County Board of Commissioners has been presented with a “Resolution of Support”, which I asked you all to support. I have since received advice from persons that have been in this fight for much longer than myself, and their advice is that a shorter and more concise “Letter of Support” would be more helpful to this cause, which I have come to agree with.
A Letter of Support has been offered to the commissioners, for their review, that covers the basic protections of Minnesota Constitutional Article 13, Section 7, “No license required to peddle. Any person may sell or peddle the products of the farm or garden occupied and cultivated by him without obtaining a license therefor.”
The letter of support covers protections given to Lake View Natural Dairy AND the consumer, both engaging in a protected private association. It is my hope that this letter of support will be adopted by the commissioners and receive their support at the regular commissioners meeting that will be held on Tuesday, March 17th at the Cook County Courthouse. Arrive at 10:00am if you would like to make a public comment or at 11:30am if you would just like to be present to show your support for Lake View Natural Dairy.
The letter has been presented as follows:
Letter of Support
The Cook County Board of Commissioners hereby declare a position of support concerning Lake View Natural Dairy (LVND) and their protection under the Minnesota Constitutional Article 13, Section 7:
“No license required to peddle. Any person may sell or peddle the products of the farm or garden occupied and cultivated by him without obtaining a license therefor. “
We believe Article 13, Section 7 protects LVND from governmental intrusions (that include not only licensing, but also inspection and regulation) when LVND is privately associating with private men and women to sell and peddle the products of their farm at their farm location.
Furthermore, we support the consumer’s right under Article 13, Section 7 to privately associate with other private farmers or gardener’s in a private relationship to purchase these products of the farm or garden.
